Franchising in the business format sector accounted for approximately 35 percent of retail sales in the U.S. in 1991. Consequently, the franchising industry has a clear ethical responsibility to the public. At the same time, there exists an ethical obligation of the two major factors in the industry — the franchisor and the franchise — toward each other. Because the franchise agreement, which is the basis of the relationship, is originated by the franchisor, an asymmetrical distribution of power often exists, (...) resulting in opportunistic behavior by the franchisor. In other cases, questionable or unethical practices by franchisees likewise result in conflict. This paper examines some of the basic areas of the franchise relationship which result in conflict, and discusses the situation analysis in business format franchising, which shows promise for reduction of conflict and unethical behavior for the future. The origin of insulin‐expressing β‐cells in the adult mammalian pancreas is controversial. During normal tissue turnover and following injury, β‐cells may be replaced by duplication of existing β‐cells.1 However, an alternative source of β‐cells has recently been proposed based on neogenesis from a Ngn3‐positive population present in regenerating pancreatic ducts.2 The appearance of β‐cells from Ngn3‐positive progenitors is reminiscent of normal pancreas development, and Ngn3‐expressing cells isolated from regenerating pancreas can generate the full repertoire of endocrine phenotypes. Darwin proposed that evolutionary novelties are environmentally induced in organisms “constitutionally” sensitive to environmental change, with selection effective owing to the inheritance of constitutional responses. A molecular theory of inheritance, pangenesis , explained the cross‐generational transmission of environmentally induced traits, as required for evolution by natural selection. The twentieth‐century evolutionary synthesis featured mutation as the source of novelty, neglecting the role of environmental induction. In view of the scope and scale of the latest scandals, e.g. Enron's maximum breaking bankruptcy, the re-discovery of ethics in business has received an impressive boost. By now even car salesmen have written ethics, a Code of Conduct, e.g. in the USA or Poland. But there is no clear aim of the role ethics obtains in organizational settings as we may show in some small cases of practical approaches to deal with ethics in organizations. We discuss how ethics is (...) the prerequisite to conduct any business and what advantages may be realized if a clear set of ethics is followed. We will discuss three practical examples. In cases of ethics-based values-added management of Siemens (Germany), Boeing (U.S.) and SAP (Germany) we explain the mechanisms of ethics in management to strengthen organizational success. We emphasize the importance of clear ethics-related communication processes in organizations. We explain the use of communication theories inside organizational processes to clarify communication about such an abstract topic as ethics. Finally, we point out how a management of ethical ideas and cultural values should be designed in business enterprises. (shrink)

First, the demonstration of Bell's theorem, i.e., of the nonlocal character of quantum theory, is spelled out using the EPR criterion of reality as premises and a gedankenexperiment involving two particles. Then, the EPR criterion is extended to include quantities predicted almostwith certainty, and Bell's theorem is demonstrated on these new premises. The same experiment is used but in conditions that become possible in real life, without the requirements of ideal efficiencies and zero background. For the last forty years our knowledge of the genealogy of the lords of Beirut from the Brisebarre family has been based on the research done by M. E. Nickerson, which was a true advance over earlier work on the same problem. Nickerson proposed the following succession of lords of Beirut.

Currently, electronic agents are being designed and implemented that, unprecedentedly, will be capable of performing legally binding actions. These advances necessitate a thorough treatment of their legal consequences. In our paper, we first demonstrate that electronic agents behave structurally similar to human agents. Then we study how declarations of intention stated by an electronic agent are related to ordinary declarations of intention given by natural persons or legal entities, and also how the actions of electronic agents in this respect have (...) to be classified under German law. We discuss four different approaches of classifying agent declarations. As one of these, we propose the concept of an electronic person (i.e., agents with limited liability), enrolment of agents into an agent register, and agent liability funds as means to serve the needs of all contracting parties. In this article we establish the existence of a number of new orbits in the automorphism group of the computably enumerable sets. The degree theoretical aspects of these orbits also are examined.

Patients suffering from chronic obstructive pulmonary diseases, frequently exhibit expiratory airflow limitation. We propose a mathematical model describing the mechanical behavior of the ventilated respiratory system. This model has to simulate applied positive end-expiratory pressure effects during expiration, a process used by clinicians to improve airflow. The proposed model consists of a nonlinear two-compartment system. One of the compartments represents the collapsible airways and mimics its dynamic compression, the other represents the lung and chest wall compartment. For all clinical conditions (...) tested, the mathematical model simulates the removal of expiratory airflow limitation at PEEP lower than 70–80% of intrinsic end-expiratory pressure, i.e. the end-expiratory alveolar pressure without PEEP. It also shows the presence of an optimal PEEP. The optimal PEEP contributes to decrease PAet from 7.4 ± 0.9 to 5.4 ± 0.9 hPa. This simplistic mathematical model gives a plausible explanation of the expiratory airflow limitation removal with PEEP and a rationale to the practice of PEEP application to airflow limited patients. ALLISON THE CLAIMTHAT KANT'S IDEALISM,or at least certain strands of it, is essentially identical to that of Berkeley has a long and distinguished history. It was first voiced by several of Kant's contemporaries such as Mendelssohn, Herder, Hamann, Pistorius and Eberhard who attacked the alleged subjectivism of the Critique of Pure Reason. 1 This viewpoint found its sharpest contemporary expression in the (...) notorious Garve-Feder review to which Kant responded at length in the Prolegomena. In subsequent times it has been championed by Schopenhauer, and most nineteenth century German commentators on the relation between the two philosophers. 2 In addition, it has been, and continues to be, the prevailing view of the vast majority of British writers on Kant, including, with significant qualifications, Norman Kemp Smith. 3 This tradition continues despite the fact that Kant specifically, and in no uncertain terms, repudiated this identification in the Prolegomena and the second edition of the Critique. In both works he responds to the charges of subjectivism, and in so doing distinguishes his position from that of Berkeley, who in the eighteenth century was commonly regarded as a solipsist and denier of the "external world." 4 In contra-distinction to Kant's own critical or transcendental idealism, which explains the possibility of synthetic a priori knowledge within the realm of possible experience, Berkeley is characterized as a "dogmatic" or "visionary idealist." Leibniz' remarkable understanding of Chinese culture was not merely the result of his own acumen, but also of the knowledgeable sources of information available to him through published works and personal correspondence. Most of the materials are preserved in the Niedersächsische Landesbibliothek Hannover. Working from the Systematischen Bandkatalog compiled by Daniel Eberhard Baring in 1720 shortly after Leibniz' death, it is possible to know with some accuracy which books were available for Leibniz' reference. This author has complied a list (...) of 78 such works, most of which were either written by or derived from Christian missionaries in China, of whom the Jesuits were the most prominent. While some of Leibniz' correspondents such as Andreas Müller of Berlin were sinological amateurs and enthusiasts, others such as the Jesuit Joachim Bouvet were learned men, living in intimate contact with the Chinese emperor in Peking. Their letters guaranteed that Leibniz' information on China was among the most accurate available in Europe at that time. (shrink)

Pp. ix + 345.This work is the first full scale study of the controversy between Kant and the Wolffian philosopher Johann August Eberhard. The controversy was launched by Eberhard’s publication in 1788 of the first part of the first volume of (...) the Philosophisches Magazin, a journal which he and a handful of associates created specifically as an organ for attacking the Kantian philosophy from the standpoint of Leibniz and Wolff. The central claim was that whatever is true in the Kantian philosophy is already contained in Leibniz, and where Kant differs from Leibniz (such as in the denial of knowledge of things in themselves or “true things”) he goes astray. Kant reacted strongly to this [End Page 632] critique, first in a pair of letters to Reinhold (May 12 and 19, 1789) and then in his own published response, with the sarcastic title: Über eine Entdeckung. nach der alle neue Kritik der reinen Vernunft durch eine ältere entbehrlich gemacht werden soll1 From Eberhard’s side the controversy continued through three more volumes of the Philosophisches Magazin (1790–92), and two volumes of its successor, Philosophisches Archiv (1792–95). Although Kant himself did not respond directly to these subsequent attacks, he contributed material to Johann Schulz for his review of the second volume of the Philosophisches Magazin.Gawlina analyzes the controversy at both the pragmatic and philosophical levels. The former includes a consideration of the motivations of the protagonists and the various strategies and tactics adopted in an attempt to convince the philosophical public of the correctness of their respective positions. Eberhard, for his part, was particularly concerned with the threat which the Critique, which Kant himself describes as the “Medusa head” (hence the title), posed to the survival of Leibnizian-style metaphysics, while Kant’s primary concern was with the misrepresentation of his own philosophy that he saw in Eberhard’s attack. At the philosophical level, the controversy is presented as a clash between two conflicting and ultimately irreconcilable philosophical paradigms: the first being the ontological orientation of Leibniz (defended by Eberhard) according to which pure (contradiction-free) thought mirrors being (this entails that logic has ontological significance), and the epistemological-transcendental orientation of Kant, according to which the fundamental questions concern the conditions of human knowledge and the justification of its claims. The author is well aware that there are epistemological elements in Leibniz and ontological ones in Kant (most notably the claims about space and time in the Transcendental Aesthetic), but he argues persuasively that these are grounded in the philosopher’s respective ontological and epistemological standpoints.This general thesis serves to illuminate virtually all of the main points of the controversy, including the question of why Eberhard refuses to admit either the significance or novelty of the analytic-synthetic distinction, while Kant insists on both. Of particular interest in this regard is the author’s discussion of the distinction between Schranken (limits) and Grenzen (boundaries), which Kant himself draws in the Prolegomena (§58). This distinction becomes relevant to the controversy because of Eberhard’s frequent appeal to the fact that Leibniz recognizes the Schranken of human knowledge as part of his attempt to show that Leibniz anticipated Kant in providing a “critique of pure reason.” As Gawlina notes, however, the limits of knowledge, as understood by Leibniz, are merely de facto constraints on the extent to which finite minds are capable of grasping things from the eternalistic perspective of God, whereas the boundaries insisted on by Kant are principled restrictions, grounded in the positive conditions of the possibility of cognition for finite knowers.
